NowPow understands the importance of user privacy, and your privacy and privacy choices matter to us. This Privacy Policy will tell you what information NowPow collects and how that information is protected and used. We ask that you read this Privacy Policy carefully.

When we say “we” or “us” or “NowPow” we mean CareIT Health, LLC d/b/a NowPow. “You” or “User” means any person who accesses or uses the Services. When we say “Services” we mean any website owned or operated by, and services offered by, NowPow, including websites at www.nowpow.com.

NowPow strives to offer Users the many advantages of Internet technology and to provide an interactive and personalized experience. In order to do so, we may obtain certain personal information from you. The purpose of this Privacy Policy (“Privacy Policy”) is to inform you about the types of information we gather about you when you access or use our Services, how we may use that information, and the choices you have regarding our use of that information. The contents of the NowPow Services, such as information, text, graphics, images, and other material provided are for informational purposes only. NowPow is based in the United States and the Services are hosted in the United States. If you are accessing the Services from outside the United States, by providing your information to NowPow and using the Services, you hereby consent to the transfer of your information to the United States for processing, storage and maintenance in accordance with this Privacy Policy and our Terms & Conditions. You are also consenting to the application of United States law in all matters concerning the Services.

NowPow reserves the right, at its sole discretion, to alter this Privacy Policy at any time without prior notice to any User of the Services, including to comply with privacy laws, regulations and/or our own or industry standards or otherwise. We encourage you to review this Privacy Policy each time you access or use the Services. Your use of the Services at any time, including after any change to this Privacy Policy, indicates your acceptance of this Privacy Policy, and any change made to this Privacy Policy.

While some Services, such as visiting the website, will not prompt a collection of information, you generally need to provide us with information to use the Services or to obtain information from most of the features on the website, including to allow us to provide you with certain personalized or enhanced services that you have requested.

We collect information on our Users in various ways, including by your voluntary submissions, and through “cookies” (as explained below) and other tracking technology. The information we collect is used in a variety of ways including, but not limited to: fulfilling and providing the Services and any other services requested by you; improving the website and our Services; notifying you about updates to the website and our Services; and/or informing about products, services, and promotions in which you may have interest. With your authorization or as otherwise permitted under this Privacy Policy, we may also share the information you provide with third parties.

Information We Collect: We may collect information from our Users including Personally Identifiable Information, Protected Health Information, Aggregate Information and other information to allow us to provide you with the personalized and enhanced services you have requested. Examples of the type of information we may collect include name, telephone number, email, and postal address.

Personally Identifiable Information: Personally Identifiable Information refers to information that tells us specifically who you are, such as your name, phone number, email, or postal address, and possibly information relating to certain support or customer service issues (collectively, “Personally Identifiable Information”). While some Services, such as visiting the website, will not prompt a collection of Personally Identifiable Information, you generally need to provide us with Personally Identifiable Information to use the Services or to obtain information from most of the features on the website, including to allow us to provide you with certain personalized or enhanced services that you have requested. How we collect and store information depends on the page you are visiting, the activities in which you elect to participate, and the Services provided. As noted, you can access or use many pages and services on the website without providing any Personally Identifiable Information. Still, other pages and services may prompt you to provide Personally Identifiable Information.

Health Insurance Portability and Accountability Act of 1996 (HIPAA): In certain instances, NowPow is subject to the Health Insurance Portability and Accountability Act of 1996, as modified by the Health Information Technology for Economic and Clinical Health Act, and its implementing regulations (“HIPAA”). Specifically, NowPow’s use and disclosure of information that NowPow creates, receives, maintains, or transmits for or on behalf of a HIPAA-covered entity that constitutes Protected Health Information (“PHI”) is subject to HIPAA. PHI refers to individually identifiable health information about an individual’s past, present or future physical or mental health or condition, the provision of health care to an individual, or the past, present or future payment for such care but only if we receive that information for or on behalf of a HIPAA-covered entity. If any information collected through the Services constitutes PHI, then NowPow will use and disclose the information in accordance with HIPAA and any applicable contractual arrangements between NowPow and the HIPAA-covered entity.

Aggregate Information: From time to time, we may collect general, non-personal, statistical information about the use of the website, such as how many visitors visit a specific web page, how long they stay on that page, and which hyperlinks, if any, they click on. This information represents a generic overview of our Users’ collective viewing habits and allows us and other third parties to modify information, promotions, offers, and/or discounts on products and services based on user traffic and behavior. We collect this information through the use of technologies such as “cookies”, which are discussed in greater detail in this Privacy Policy. We collect this information in order to determine, for example, which areas of the Services are most popular and to enhance the Services. We may also group this information into aggregate visitor data in order to describe the use of the Services to our existing or potential business partners or other third parties, or in response to a government request. From time to time, we may use this information to optimize third-party offers of products and/or services. We also may share aggregated demographic and preference data with third parties to enable the provision of targeted information. Cookies and Other Tracking Technologies: The Services also may collect information automatically and through the use of electronic tools that may be transparent to Users. For example, we may automatically collect non-Personally Identifiable Information and data through the use of “cookies”. Cookies are small text files a website uses to recognize repeat Users, facilitate the User’s ongoing access to the website and facilitate the use of the website. An IP address is a number that is automatically assigned to your computer whenever you are surfing the web. Web servers, the computers that “serve up” webpages, automatically identify your computer by its IP address.

We may link the information we record using tracking technologies to Personally Identifiable Information we collect through the Services for our own marketing purposes. In addition, we reserve the right to use IP addresses and other tracking technologies to identify a visitor when we feel it is necessary to enforce compliance with our Terms & Conditions, to protect the Services, our customers or others, or when we believe in good faith that the law requires it.

Do Not Track: We automatically collect cookies and other non-Personally Identifying Information when you use the Services. We currently use third-party cookies, as discussed above, to track your visits across websites. While our collection of cookies does not include Personally Identifying Information, you may opt out of such collection in accordance with applicable laws by contacting us pursuant to Section 9 of this Privacy Policy.

Website Analytics: Like many websites, our Services uses Google Analytics to collect information about your use of our Services. This information consists of information that your web browser automatically sends to Google, such as the web address of the page that you visit and your IP address. Google may also set cookies or read preexisting cookies. This information is stored on Google´s servers. Google uses this information to provide us with reports about traffic to our website and your visit to our website (such as the domain from which you access the internet, the web address of the website from which you linked to our site, the time and date of your visit to the web pages that you view and click through). We will use this data to improve our website structure and content.

We may share information about you with third parties as follows:

Aggregate Information: We may share user information in the aggregate with third-party advertisers and content distributors for our own marketing purposes. For example, we may disclose the number of Users that use the Service, how they use the Service, and basic non-personal demographic data. We will not share to third parties your personal information in a manner that identifies you for any direct marketing purposes by such third parties nor sell information that could be used to identify you as an individual.

Investigations: We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure is (a) reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; (b) helpful to prevent, investigate, or identify possible wrongdoing in connection with the Service; or (c) protect our rights, reputation, property, or that of our users, affiliates, or the public.

Our Suppliers: We contract with a number of service providers and vendors that will have access to your information as necessary to provide the Service. These service providers and vendors consist of our third-party information technology vendors and our customer service call center vendors. Information shared may include, but is not limited to, your Personally Identifiable Information, the analytics tools discussed above, and other analytic tools used to report information to us should we experience technical issues with the Service or for various other purposes related to providing the Service.

Sale or Transfer of Business or Assets: If we are sold or disposed of as a going concern, whether by merger, reorganization, sale of assets or otherwise, or in the event of an insolvency, bankruptcy or receivership, any and all Personally Identifiable Information may be one of the assets sold or merged in connection with that transaction. Information about you may also need to be disclosed in connection with a commercial transaction where we or any one of our businesses are seeking financing, investment, support, or funding.

We take reasonable precautions to protect the privacy, accuracy, and reliability of any information you provide and to protect such information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. The Personally Identifiable Information you provide and we collect is stored within databases that are controlled by us or by our service providers. As we deem appropriate, we use security measures consistent with industry standards, such as firewalls and encryption technology, to protect your information. However, since no security system is impenetrable, we cannot guarantee the security of our databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet. As a result, you transmit any information to or from the Services at your own risk.

If you have submitted Personally Identifiable Information through the Services, you may be able to review, edit, and control how we use much of this information, by contacting us at info@NowPow.com. We may require proof of your identity before we edit or provide you with the requested information. We will use reasonable efforts to supply you with this information and to correct any factual inaccuracies that you identify. Please also contact us at info@NowPow.com or if you do not want us to disclose your Personally Identifiable Information to third parties or you want us to delete your Personally Identifiable Information from our databases. Keep in mind, however, that there may be residual information within our databases, access logs and other records, which may or may not contain such information. The residual information will not be used for commercial purposes; however, we reserve the right, from time to time, to re-contact former Users of the Services. We allow you to challenge the data that we hold about you and, where appropriate, you may have the data erased, rectified, amended, or completed in accordance with applicable laws.

The Services may contain links to unaffiliated third-party websites. NowPow is not responsible for the actions or policies of such third parties. You should check the applicable privacy policies of those third parties when providing information on a feature or page operated by a third party. NowPow expressly disclaims any and all liability for the actions of third parties, including but without limitation to actions relating to the use and/or disclosure of Personally Identifiable Information by third parties.

We understand and share your concerns regarding your children’s access to Internet and the Internet’s access to your children. Consistent with the Children’s Online Privacy Protection Act of 1998 (COPPA), we do not knowingly request or accept Personally Identifiable Information submitted to the Services by any visitor under 13 years of age. If you become aware that your child has used the Services, and we may have Personally Identifiable Information about a user under 13, please contact us.

This Privacy Policy shall be governed by the laws of the State of Illinois, without regard to conflicts of law principles. Any action relating to this Privacy Policy must be filed and maintained in a state or federal court of competent jurisdiction located in Illinois, and each User consents to exclusive jurisdiction and venue in such courts for such purpose. NowPow makes no representation that this Privacy Policy and such practices comply with the laws of any country outside the United States.
